Swell Feels Terms of Use

These terms are an agreement between you and Parker L Hansen LLC, a California limited liability company ("we", "us"), which makes Swell Feels. By creating an account or using the app, you agree to them. If you don't agree, don't use the app.

What Swell Feels is

Swell Feels is a personal journal for logging surf sessions and reflecting on how they felt. It is a self-reflection tool. It is not therapy, counseling, medical care, diagnosis or treatment of any kind.

No professional relationship

Some of the people who make Swell Feels may hold professional licenses. Using the app does not create a therapist-client relationship, or any other professional relationship, with them or with anyone else. Nobody reads or monitors what you log, and we won't respond to it. Nothing in the app, including its prompts, feelings, patterns or summaries, is professional advice.

If you're struggling

Swell Feels can't help in a crisis. If you're thinking about harming yourself or you're in danger, call or text 988 (Suicide & Crisis Lifeline) in the US, call 911, or contact your local emergency number. For ongoing support, reach out to a licensed professional.

Surf conditions and safety

Tides, swell, wind, water temperature and spot locations come from outside sources (NOAA, Open-Meteo and OpenStreetMap) and from what you enter. They can be late, incomplete or wrong, and they're for your records only. Never use them to decide whether it's safe to go in the water. Surfing is dangerous and you are responsible for your own safety. Check official, live sources and the conditions in person.

Who can use Swell Feels

You must be at least 13 years old. If you're under the age of majority where you live, you need a parent or guardian's permission, and they agree to these terms for you.

Your account

Keep your sign-in details secure. You're responsible for what happens under your account. If you think someone else has accessed it, email us. You can delete your account at any time in Settings > Delete account. This permanently removes your account and everything logged in it, and it can't be undone.

Your content

You own what you log. You give us only the permission we need to store it and show it back to you so the app works. We don't sell it, use it for advertising, or use it to train AI. Share images are created and sent by you, so you're responsible for what you share, including the names of people you surfed with.

Acceptable use

Don't use Swell Feels to break the law, access anyone else's account or data, overload or attack the service, get around its security, or collect data with automated tools. We may suspend or delete accounts that do.

Your license to use the app

We give you a personal, non-transferable license to use Swell Feels on Apple devices you own or control, as allowed by Apple's App Store Usage Rules. The app, its design and its name belong to us.

Purchases and refunds

Swell Feels is a one-time purchase with no subscription and no recurring charges. Purchases are processed by Apple, not by us. To request a refund, go to reportaproblem.apple.com or your device's purchase history. We can't process or approve refunds ourselves. If you're in the EU or UK, you may also have a legal right to a refund within 14 days of purchase.

Changes to the app

We may add, change or remove features. If we ever stop running Swell Feels, we'll tell you in the app at least 30 days before, so you can export your data.

Disclaimers

Swell Feels is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise the app will be uninterrupted, error-free or that data will never be lost. Keep your own copy with Settings > Data > Export.

Limitation of liability

To the fullest extent the law allows, Parker L Hansen LLC and its members, employees and contractors won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any injury, loss of data or other loss that comes from using Swell Feels or relying on anything in it, including conditions data. Our total liability for any claim is limited to the greater of what you paid for the app or $50. Some places don't allow these limits, so they may not fully apply to you.

Indemnity

If you break these terms or misuse the app and that leads to a claim against us, you agree to cover our reasonable losses and costs, including legal fees.

Apple

These terms are between you and us, not Apple. Apple isn't responsible for the app, its content, maintenance or support. If the app doesn't meet an applicable warranty, you can tell Apple and Apple will refund the purchase price, and Apple has no other warranty obligation. We, not Apple, are responsible for handling any claims about the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims. You confirm you're not in a country under a US government embargo and not on a US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Disputes and governing law

If you have a problem, email us first and we'll try to sort it out within 30 days. These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts in San Diego County, California, unless the consumer protection laws where you live give you the right to bring it there instead.

Ending your use

You can stop using Swell Feels and delete your account at any time. We may suspend or end your access if you break these terms. The sections on your content, disclaimers, limitation of liability, indemnity and disputes still apply after that.

Changes to these terms

If we change these terms in a way that affects your rights, we'll tell you in the app before the change takes effect. If you keep using the app after that, you accept the new terms. If any part of these terms can't be enforced, the rest still applies. These terms and our Privacy Policy are the whole agreement between you and us about Swell Feels.
